You agree to use Shapr3D prerelease and limited-audience versions (together “Test version”) in accordance with all the below detailed terms of use. SHAPR3D Zrt. (registered seat: H-1054 Budapest, Akadémia utca 6.; registration number: 01-10-048757), (“we”) reserve the right to amend these Terms in our sole discretion. You acknowledge that you shall be notified of any such amendment when new terms enter into force by us publishing it on this website. You understand that you expressly accept such amendments by continuing to access and use the Test version. These terms apply to every Test version, any deviations applicable to specific version are indicated.
The Test version is accessible exclusively to those who are invited and who agree with these terms. You acknowledge that we reserve the right, at our discretion, to decide who gets invited to access the Test version. You acknowledge that testing any Test version does not entitle you to use any final version. You understand that access to the final version is only upon agreeing to our Terms of Use or entering into a separate agreement and upon payment of a possibly applicable fee. You agree that without our prior written authorization you will not share your access to the Test version with any other person who has not been invited.
We are engaged in the ongoing development of Shapr3D. With the Test version, you can test new and upcoming features and provide us feedback about your experience. Feedback we receive allows us to make improvements to these upcoming features, ensuring a great user experience once the final version is released.
You acknowledge that the Test version is being provided on an “As Is” basis meaning that it may contain bugs, errors, defects, harmful components or other problems. You acknowledge and agree that we shall not be held liable for such problems, and we expressly disclaim all liability for any consequences arising therefrom. You acknowledge that we are not obliged to provide any technical or other form of support.
We encourage you to help us improve the Test version by sharing with us any of your comments, impressions or experiences. However, such feedback must be shared exclusively through designated channels that we provide for this purpose. You can find the list of such accepted, designated channels to share your opinion about Shapr3D Beta here, while commenting Shapr3D Gamma is permitted only through the Circle (together “designated channels”). You acknowledge that sharing any feedback or detail outside these designated channels is not permitted and may entail legal consequences.
You agree that any of your feedback may be used for our business purposes without any further consent or accounting in the manufacture, maintenance, development and marketing of any of our products or services. You agree that the use of the Test version and any form of contribution to our improvement does not grant any right (in particular no right of ownership) to you. You acknowledge that our group companies exclusively own all rights, title and interests including but not limited to all intellectual property rights related to the Test version and any of its modifications, improvements or derivatives.
You acknowledge that we reserve the right to modify the Test version any time without prior notice. You understand that we do not guarantee that the final, launched version of the Test version will be identical to the one that you may have become familiar with during the test period. You also acknowledge that there is no guarantee that the final version will be constructed considering any feedback made by you or any other Test version user. You acknowledge that we may decide on our sole discretion not to release a generally available final version.
We share a lot of sensitive and insider information in the Test version. The Test version and any related information are strictly confidential. You acknowledge that any release damages our competitive and intellectual property interests and may entail legal consequences. Sharing of any information that you get from the Test version to third parties is not permitted. You agree that you will not disclose feedback or transfer any information, data or details outside the designated channels. You agree that you will not commercially exploit or make available to any third party the Test version or any related details in any way. You agree that you will not create a competitive product or service, a product using similar ideas, or copy any ideas.
You can opt out of use of the Test version any time. You acknowledge that we may decide to limit, suspend, deny or terminate your access to the Test version any time without prior notice in our sole discretion. You understand that you will lose your Gamma membership if you do not use Shapr3D Gamma at least 3 hours a week before its public release.
You acknowledge that we process the personal data provided by you according to our Privacy Policy. You confirm and declare that you obtained the consent of those data subjects whose data is disclosed by you in the Prerelease version.
You understand that to the extent permitted by law, we provide access to the Test version without any liability. To the extent permitted by applicable law, we disclaim all warranties and conditions of any kind. No information or advice, whether oral or written, obtained by you from us shall create any warranty not expressly made herein. You understand that we disclaim all liability for the fate of any data (including trade secrets) disclosed by you using the Test version. You agree that you assume all risks and all costs associated with your use of the Test version including, but not limited to any internet access fees, damage to any equipment, software, information or data.
You agree that to the extent permitted by law, any dispute arising from or relating to these Terms shall be governed by the Hungarian law and fall under the exclusive jurisdiction of the competent courts of Hungary.
